Spouse of Highly Skilled Migrant Netherlands: What Your Partner Permit Covers

Moving to the Netherlands as the spouse or partner of a highly skilled migrant (kennismigrant) places you in a specific and generally favourable immigration position — but it comes with a dependency that many people underestimate. Your legal right to remain in the Netherlands is tied to your partner's employment status. When that employment status changes, your permit situation changes too. Understanding exactly what your permit covers and what keeps it stable is essential reading before you make the move.

What the HSM Spouse Permit Is

When a highly skilled migrant (or EU Blue Card holder) receives their residence permit for the Netherlands, their non-EU partner can apply for a dependent residence permit. This is a standard family partner permit — the same TEV procedure applies — but the sponsor's permit type (highly skilled migrant rather than Dutch national or settled resident) affects some of the parameters.

Work rights: Full. The dependent partner permit is marked "Arbeid vrij toegestaan" (employment freely permitted). You can work for any employer in any sector in any capacity without needing a separate work permit. There is no restriction on type of employment, number of hours, or industry.

Integration obligations: Unlike partners of Dutch nationals, you may or may not face the civic integration exam abroad requirement, depending on your nationality. Partners of highly skilled migrants from certain nationalities are sometimes exempt from the full civic integration exam — check the IND's country-specific guidance. Post-arrival integration obligations under the Wet Inburgering 2021 generally apply.

Duration: The permit is tied to the highly skilled migrant's permit. If your partner's HSM permit is valid for 3 years, your dependent permit is valid for 3 years (or until the HSM permit expires, whichever is first). If the HSM permit is renewed, your permit should be renewed simultaneously.

The Dependency Risk: What Happens When Your Partner Changes Jobs

This is the most important thing to understand about an HSM-dependent permit. The highly skilled migrant's permit is tied to a specific employer. If your partner changes jobs, the HSM permit itself changes — a new employer must recognise the new employer as the sponsor. During the transition, there can be a gap.

If your partner's employment ends for any reason — voluntary resignation, redundancy, or dismissal — the highly skilled migrant has a three-month grace period to find new HSM-qualifying employment (or find another permit basis). During those three months, your dependent permit remains technically valid.

However: if the three months pass without a solution, your partner's HSM permit status becomes uncertain, and your dependent permit is at risk. The IND can initiate proceedings to revoke a dependent permit when the underlying sponsor permit is revoked.

This is why some spouses of highly skilled migrants pursue their own income and work rights aggressively — building an independent employment history in the Netherlands is the best protection against the dependency risk.

How the Income Requirement Works for HSM Sponsors

The income requirement for highly skilled migrant sponsors is different — and higher — than for regular sponsors. For 2026, the HSM salary thresholds are:

These thresholds represent the salary your partner must earn to qualify for the HSM permit in the first place. Because the HSM permit application already verifies the income, the dependent partner application builds on that established income profile — you do not need to separately demonstrate income sufficiency in the same way as a regular partner application.

However, the IND still verifies that the HSM permit remains valid and the income remains above threshold at the time the dependent permit is assessed.

What the Civic Integration Exam Situation Looks Like

Partners of highly skilled migrants from nationalities that are exempt from the MVV requirement (US, Canada, Australia, Japan, etc.) do not need to pass the civic integration exam abroad. They travel to the Netherlands on their regular passport and apply for the residence permit from within the Netherlands.

Partners of HSMs from non-exempt nationalities face the same civic integration exam requirement as other partner visa applicants — the Basisexamen Inburgering Buitenland (A1 level), taken at a Dutch embassy before the TEV application is submitted.

Post-arrival, integration obligations under the Wet Inburgering 2021 generally apply to non-EU spouses of HSMs unless a specific exemption applies. The most common exemption is if you hold a diploma from a Dutch-language educational institution.

Building Independent Status Over Time

Five years of continuous legal residence in the Netherlands, combined with a passed civic integration exam and sufficient income, qualifies you for permanent residence — independently of your partner's HSM status. At that point, the dependency relationship ends from an immigration law perspective.

If you have been working during those five years (which your permit fully allows from day one), you will likely also meet the income requirement for permanent residence independently. This combination — five years of residence plus independent income — is the strongest possible position, giving you full autonomy over your residency status regardless of what happens to your partner's employment situation.
