AI-ECTA: How Indian Students Get Longer Post-Study Work Rights in Australia

While every international student in Australia is dealing with tightening visa conditions, rising fees, and the brutal 485 visa point score race, one group has a structural advantage most people are not fully utilising. Indian passport holders who graduated from Australian institutions receive extended post-study work rights under the Australia-India Economic Cooperation and Trade Agreement (AI-ECTA) — an extra year of time on their 485 Temporary Graduate Visa that is simply not available to graduates from most other countries.

Given that the 485 visa window is the only period during which you can accumulate the skills assessment, work experience, and migration points needed for PR, an extra 12 months is substantial. It is the difference between a cramped two-year scramble and a more considered three-year strategy.

What AI-ECTA Actually Provides

The Australia-India Economic Cooperation and Trade Agreement, which entered into force in December 2022, includes a bilateral commitment to extended post-study work rights for qualifying Indian graduates. The extended durations under AI-ECTA are:

The key beneficiary is the Indian graduate holding a Master's by Coursework or a Bachelor's (Honours, First Class) in a STEM or ICT field. These graduates receive a 485 visa duration of three years instead of the standard two — providing one extra year of open work rights without requiring regional study or a second 485 application.

For PhD graduates, the AI-ECTA extension to four years is also significant, providing additional runway for research transition into the skilled migration system.

Why This Extra Year Matters

Consider the typical timeline for an Indian IT graduate aiming for PR:

  • Month 0: Course completion letter received. Six-month window to lodge 485 opens.
  • Month 1-2: Lodge 485 visa application. ACS Post Australian Study assessment application submitted simultaneously.
  • Month 3-6: 485 granted. ACS assessment returned (6 to 8 weeks typical processing).
  • Month 6 onwards: Begin accumulating skilled employment for SkillSelect points claim.

Under the standard 2-year duration, you have approximately 18 to 20 months of skilled employment time after your ACS assessment comes back. For experienced candidates, 2 years of claimed employment adds 5 points (years 3-7 of skilled employment are the most point-productive bracket).

Under the AI-ECTA 3-year duration, you have 28 to 30 months of skilled employment accumulation. You can claim 3 years of skilled employment, which has the same point value as 2 but allows more time to receive a state nomination invitation before your visa expires.

More critically: the extra year means you can wait for a state nomination round to open at a competitive cut-off rather than being forced to lodge a suboptimal EOI because your visa is about to expire.

What Qualifies for the AI-ECTA Extension

The AI-ECTA extended duration is not automatic for every Indian graduate. The eligibility conditions are:

  • You must be an Indian passport holder at the time of 485 application
  • Your degree must be from a CRICOS-registered Australian provider
  • For the Bachelor's extension: you must hold First Class Honours in a STEM or ICT field. A Bachelor's pass without Honours designation, or a Bachelor's in a non-STEM field (e.g., business, arts, law), does not qualify for the extended duration
  • For the Master's extension: any Master's by Coursework or Extended qualifies (not just STEM)

Importantly, the First Class Honours requirement for Bachelor's degrees filters out a significant portion of graduates. If your Bachelor's grade does not meet the First Class Honours threshold, you receive the standard 2-year Post-Higher Education stream duration rather than 3 years, even as an Indian national.

Check your degree classification explicitly before assuming you qualify for the AI-ECTA extension.

AI-ECTA and the Evidence Level 3 Context

The AI-ECTA benefit exists alongside the more challenging reality for Indian students in 2026: India has been classified as Evidence Level 3 under the Simplified Student Visa Framework, subjecting Indian applicants to heightened scrutiny and higher documentation requirements for the initial Subclass 500 application.

The Q1 2026 refusal rate for Indian student visa applicants was 40 to 42 percent — the highest in a decade. A Genuine Student (GS) statement that fails to clearly articulate why your specific Australian course provides unique value unavailable in India, or that uses AI-generated language inconsistent with your IELTS 7.0 score, will be refused regardless of your AI-ECTA eligibility for post-study work rights later.

The AI-ECTA benefit is only valuable if you successfully obtain the Subclass 500 visa in the first place. The GS statement preparation is where most Indian applications fail.

Stacking AI-ECTA with Regional Study

AI-ECTA and regional study bonuses are not mutually exclusive. An Indian Master's graduate who studied in Adelaide (Category 2 regional zone) qualifies for:

  • AI-ECTA 3-year 485 duration (from their degree, no need for second 485 in many cases)
  • 5 regional study bonus points
  • Access to South Australian state nomination rounds
