Most professionals with a master's degree or a relevant bachelor's and five years of experience will qualify for EB-2 — but qualifying for something does not always mean it is the fastest or best path. The choice between EB-2 and EB-3 is not purely about eligibility; it is a strategic decision that depends heavily on your country of birth and where the Visa Bulletin dates happen to sit.

Eligibility: What Each Category Requires

EB-2 (Employment-Based Second Preference)

EB-2 targets advanced degree professionals and persons of exceptional ability. You must either:

  • Hold a U.S. master's degree (or foreign equivalent) in a field relevant to the job, or
  • Hold a bachelor's degree plus at least five years of progressive post-baccalaureate experience as the equivalent, or
  • Qualify under the exceptional ability standard (meeting at least three of six regulatory criteria demonstrating expertise significantly above the ordinary)

EB-2 also includes the National Interest Waiver (NIW) — the only employer-free self-petition option among the major employment-based categories.

EB-3 (Employment-Based Third Preference)

EB-3 covers three distinct groups:

  • Skilled workers: Positions requiring at least two years of training or experience
  • Professionals: Jobs that require a bachelor's degree (or equivalent)
  • Other workers: Jobs requiring fewer than two years of training

The professional subcategory (bachelor's degree required) has some overlap with EB-2. A software engineer with a bachelor's degree and no graduate degree may qualify for EB-3 as a professional but not for EB-2. An engineer with a master's qualifies for EB-2 — and strategically, may choose EB-3 depending on current Visa Bulletin dates.

Priority Date Movement: Where the Strategy Gets Complicated

For most nationalities, the strategic difference between EB-2 and EB-3 is minimal. Both categories are currently current for the Rest of World — meaning a new filer from most countries gets a green card within roughly 2.5 to 3 years via the PERM route, regardless of which category they file in.

For Indian and Chinese nationals, the comparison is entirely different because each category has its own country-specific backlog that moves independently:

  • India EB-2: July 15, 2014
  • India EB-3: January 15, 2015
  • China EB-2: September 1, 2021
  • China EB-3: June 1, 2020

The dates fluctuate month to month. Historically, there have been extended periods when India EB-3 moved faster than EB-2 — sometimes by months, occasionally by years. During those periods, applicants with approved EB-2 I-140s and PERM certifications would file a new EB-3 I-140 (using the same PERM), capture their original earlier priority date in the EB-3 category, and file I-485 sooner. This "EB-2 to EB-3 downgrade" strategy has saved some Indian nationals years of additional waiting.

As of mid-2026, the State Department has aligned India EB-2 and EB-3 dates relatively closely — the Dates for Filing dates sit within weeks of each other. The downgrade strategy provides minimal benefit at this moment, but the bulletin shifts monthly. The option remains available and worth monitoring.

When EB-3 Makes More Sense Than EB-2

If you do not qualify for EB-2. A candidate with only a bachelor's degree and fewer than five years of post-degree experience does not meet EB-2 requirements. EB-3 professional is the correct category.

If EB-3 India has a meaningfully earlier priority date. Watch the monthly Visa Bulletin. If EB-3 India is 12+ months ahead of EB-2 India on the Dates for Filing chart, filing an EB-3 I-140 (alongside or instead of EB-2) to lock in an earlier date may be worthwhile.

If your employer is more comfortable with EB-3. Some employers have existing PERM templates and relationships with DOL for EB-3 professional filings. While this should not drive the decision alone, practical sponsorship matters.

Filing Both Categories Simultaneously

Many Indian and Chinese nationals use a dual-filing strategy: the employer files both an EB-2 PERM and an EB-3 PERM simultaneously (or sequentially), resulting in two approved I-140s in different categories. This captures two priority dates — one in each category — and allows the applicant to file I-485 against whichever becomes current first.

The cost is the duplicated PERM and I-140 fees. The benefit is insurance against unpredictable bulletin movement. For someone facing a 10+ year wait, the flexibility is worth the investment.

Comparing Timelines

For Rest of World applicants, EB-2 and EB-3 both reach the I-485 stage in roughly 2.5 to 3 years via the PERM route. The NIW pathway (EB-2 only) is faster: approximately 12 to 24 months end-to-end.

For Indian nationals, both categories are measured in years of backlog, not months. The choice is tactical — about which date is more current on the Visa Bulletin in any given month.

The Bottom Line

If you qualify for EB-2, filing in that category is generally the right starting move — particularly because it preserves the option to self-petition via NIW and because EB-2 is the stronger category for H-1B cap-out extensions. EB-3 is a tactical supplement, not a replacement.

Monitor the Visa Bulletin monthly. If EB-3 dates move ahead materially, consult with your employer about adding an EB-3 filing to capture a concurrent position in both queues.
