The honest answer to "how long does EB-5 take?" depends on a single factor more than any other: which visa category your project falls into. Choose a rural set-aside project and you might hold an unconditional green card in three to four years. Choose an unreserved urban project as a Chinese national and you could be looking at decades.

This is not hyperbole. The May 2026 Visa Bulletin shows the Final Action Date for China Unreserved at September 22, 2016. Investors from mainland China who file unreserved petitions today join a queue where the front of the line is nearly ten years behind the present date.

The Two Variables That Control Your Timeline

Variable 1: Project category — Rural TEA, High-Unemployment TEA, Infrastructure, or unreserved. Each category has its own visa queue, with separate annual allocations.

Variable 2: Your country of birth — Not citizenship, birth. EB-5 visa usage is tracked by country of chargeability based on your country of birth. For most countries, all four categories show "Current" status, meaning no backlog. For mainland China and India, unreserved backlogs are severe.

"Current" means no backlog — a visa number is available as soon as your I-526E is approved. The set-aside categories are current for every country including China and India, which is why investors from backlogged countries who select set-aside projects can move through the process far faster.

This set-aside advantage will not last indefinitely. Demand data shows that high-unemployment area petitions are heavily oversubscribed — over 90% of urban HUA petitions remain pending, with an estimated visa shortage of 6,500. Future retrogression in the high-unemployment set-aside is statistically probable. Rural projects currently remain the fastest pathway because their processing is explicitly prioritized by statute.

Typical EB-5 Timeline by Stage

Stage 1: Preparation (3–6 months) Selecting a project, completing due diligence, assembling source of funds documentation, retaining attorneys, and preparing the I-526E petition package typically takes three to six months. Source of funds for complex multi-jurisdictional wealth takes longer.

Stage 2: I-956F and I-526E adjudication (6–24 months, varies widely) Under the RIA's FIFO inventory management protocol implemented in March 2026, USCIS will not adjudicate an individual investor's I-526E until it has made an official determination on the project's underlying I-956F form. The project approval acts as the gateway pacing item.

Once the I-956F is approved, rural petitions receive priority processing and have been adjudicated in some cases in under 12 months. High-unemployment and unreserved petitions wait in standard FIFO queues and face longer adjudication times. Premium processing is not available for any EB-5 petition.

Stage 3: Visa availability After I-526E approval, visa availability is governed by the Visa Bulletin. For set-aside categories currently showing "Current," a visa number is immediately available. For Chinese nationals in the unreserved category, there is no visa number — the queue waits for the Final Action Date to advance.

Stage 4: Adjustment of status or consular processing (8–18 months) Investors inside the U.S. file I-485 (Adjustment of Status). Investors outside the U.S. proceed through consular processing via DS-260. Both paths take roughly 8 to 18 months under current conditions. During concurrent filing (when permitted), the I-485 is filed simultaneously with the I-526E, shortening this stage.

Stage 5: Conditional green card (2 years) Upon I-485 approval or consular processing completion, you receive a conditional green card with a two-year validity. The two-year clock starts running.

Stage 6: I-829 (removal of conditions) (12–24 months) Filed 90 days before the conditional green card expires. Processing time currently ranges from 12 to 24 months. USCIS extends conditional status automatically while the I-829 is pending.

Concurrent Filing: The Timeline Shortcut for U.S.-Based Investors

If you are lawfully present in the United States on a non-immigrant visa (H-1B, F-1, L-1, O-1, E-2, or others) and a visa number is immediately available in your project's set-aside category, you can file Form I-485 concurrently with Form I-526E. This is one of the most significant advantages the RIA introduced.

Concurrent filing means you can apply for an Employment Authorization Document (EAD) and Advance Parole (AP) at the same time as your I-526E. EAD and AP are typically issued within 3 to 4 months of filing, liberating you from employer visa sponsorship while your EB-5 petition is adjudicated. For an H-1B worker facing H-1B extension uncertainty, this is significant.

What "Retrogression" Means

Retrogression occurs when a visa category that was previously "Current" receives a past-date cutoff — meaning USCIS will only process petitions with priority dates before a specified date. Retrogression happens when demand exceeds annual visa supply.

The high-unemployment set-aside is showing early signs of oversubscription. If demand continues at current rates, the high-unemployment category will retrograde for Chinese and Indian nationals within the next few years. Rural remains the safest bet for investors from high-demand countries.

The September 30, 2026 Grandfathering Deadline and Its Timeline Impact

Investors who file their I-526E by September 30, 2026, receive statutory grandfathering protection. This means that even if the Regional Center Program expires or changes after that date, USCIS must continue processing and adjudicating the petition under the existing statute.

Given that source of funds preparation typically takes three to six months, the practical deadline to start the process is now. An investor who begins documentation in October 2026 will miss the window entirely.
