H-4 EAD Document Checklist and Photo Requirements for 2026

A Request for Evidence on your H-4 EAD application can add weeks or months to your processing time. With no automatic extension for renewals filed on or after October 30, 2025 and processing already running 6-10 months, an RFE can be the difference between keeping your job and a forced employment gap.

Most RFEs are preventable. They stem from missing documents, non-compliant photos, or incomplete form fields. Here's the complete checklist to get it right the first time.

Complete Document Checklist

Form and Fees

  • Form I-765 (edition 08/21/25) — check the USCIS website for the current version; using an outdated form results in automatic rejection
  • Filing fee: $470 (online) or $520 (paper filing)
  • No Form I-907 for the H-4 EAD: H-4 category (c)(26) I-765 filings are not eligible for premium processing

Identity Documents

  • Passport: Copy of the biographic page. Must be unexpired at the time of filing. If your passport expires during processing, include a copy of both the expired and the renewal passport.
  • I-94: Print your current I-94 from the CBP website (i94.cbp.dhs.gov). Don't use an old paper I-94 if you've had subsequent entries.
  • Previous EAD card: For renewal applications, include front and back copies.

Status Evidence

  • H-4 I-797 approval notice: Your most recent H-4 status approval from USCIS.
  • H-1B spouse's I-797: Current H-1B approval notice showing valid status.

Eligibility Evidence

  • I-140 approval notice: The H-1B spouse's I-797 showing I-140 approval. This is the most common missing document — it belongs to your spouse's employer immigration file, not yours. Request a copy well in advance.
  • AC21 evidence (if applicable): If qualifying through the AC21 extension pathway instead of I-140 approval, include PERM labor certification filing receipts showing 365+ days pending.

Marriage Verification

  • Marriage certificate: Original language copy plus a certified word-for-word English translation if the certificate is in any other language. The translation must include a certification statement from the translator.

Photo Requirements: USCIS Specifications

Photos are a leading cause of RFEs. USCIS updated its photo policy in late 2025, and the specifications are strict:

Size and format:

  • Exactly 2 inches × 2 inches (51mm × 51mm)
  • Head must be between 1 inch and 1 3/8 inches (25mm to 35mm) from chin to crown
  • Printed on photo-quality paper (not regular printer paper)

Technical requirements:

  • White or off-white background
  • Recent, current color photographs meeting USCIS specifications
  • Full face and front view; both ears do not have to be visible
  • Neutral expression, mouth closed
  • No glasses in standard passport-style photos
  • No head coverings except for religious reasons (face must be fully visible)
  • No shadows on face or background

Common rejection triggers:

  • Photo taken with a phone camera in poor lighting
  • Background outside the permitted white or off-white range (for example, a patterned background)
  • Image that's too dark or oversaturated
  • Head tilted or not centered
  • Wearing earbuds, headphones, or hearing devices that obscure the ear

Get your photos taken at a professional passport photo service. The $15 cost is nothing compared to the 60-90 day delay from an RFE.

Biometrics Appointment: What to Expect

After USCIS receives your I-765, USCIS may issue a biometrics appointment notice (ASC Appointment Notice) if biometrics are required in your case. Do not assume that an appointment will be waived or scheduled; follow the notice USCIS sends.

At the appointment:

  • Bring your ASC appointment notice, a valid photo ID (passport), and your I-797C receipt notice
  • USCIS will capture your fingerprints, photograph, and signature
  • The appointment takes 15-30 minutes

If you can't attend your scheduled date, call the USCIS Contact Center (800-375-5283) to reschedule before the appointment date. Missing a biometrics appointment without rescheduling can result in case denial.

Timeline impact: The timing and effect of biometrics are case-specific. Complete any appointment promptly because USCIS may not adjudicate the case until required biometrics are completed.

How to Organize Your Filing Package

Whether filing online or by mail, organize documents in this order:

  1. Form I-765 (signed)
  2. Filing fee (use the current USCIS payment method for the filing; paper filers may use Form G-1450 for card payment or Form G-1650 for ACH where permitted)
  3. Two passport photos (paper filing: tape lightly to a sheet; online: upload as JPEG)
  4. Passport copy
  5. I-94 printout
  6. H-4 I-797 approval notice
  7. Marriage certificate + translation
  8. H-1B spouse's I-797 (current status)
  9. H-1B spouse's I-140 approval notice
  10. Previous EAD card copy (renewals)

For paper filing, include a cover letter listing all enclosed documents. It's not required but helps the mailroom route your application correctly and reduces processing errors.
