STEM OPT RFE: Why USCIS Sends Them and How to Respond

Getting an RFE on your STEM OPT application is not automatic rejection. It is USCIS telling you that something in the initial filing raised a question — and that you have a limited window to answer it before they decide. The window is typically 87 days from the date on the notice. Miss it, or respond inadequately, and USCIS will deny the application.

The stakes are high. A denial means you lose your work authorization, your 180-day automatic extension stops, and your employer must stop paying you immediately. Understanding why USCIS issues STEM OPT RFEs — and what a strong response looks like — is worth understanding before you file, not after.

Why USCIS Issues STEM OPT RFEs

STEM OPT RFEs cluster around a small number of recurring problems. Most are avoidable with careful preparation.

Weak or Generic Training Plan Objectives

This is the single most common RFE trigger. USCIS adjudicators are tasked with verifying that the employment constitutes genuine structured training, not a labor arrangement dressed up in educational language. When the Form I-983 Section 5 reads like a job posting — "develop software, collaborate with teams, improve product quality" — it fails that test.

An adjudicator who sees vague objectives will issue an RFE asking you to demonstrate a direct, specific relationship between the degree's academic content and the daily duties of the position. The question they are asking: does this job actually train you in your field, or is the I-983 just a paperwork exercise?

Strong training objectives name specific methodologies, frameworks, or theoretical applications drawn from the qualifying degree. A data science I-983, for example, should reference specific algorithms, statistical models, or analytical frameworks learned during graduate coursework, and show how the role requires applying and extending those techniques. "Analyzing data to support business decisions" does not accomplish that. "Applying regularization techniques from supervised machine learning coursework to reduce model overfitting in the company's customer churn prediction pipeline" does.

E-Verify Discrepancies

USCIS cross-checks the E-Verify Company ID or Client Company ID submitted on the I-765 against its records. Common problems include:

• Using the EIN instead of the E-Verify ID (they are different numbers)
• The employer's E-Verify account being inactive or suspended at the time of filing
• A corporate restructuring that changed the employer's E-Verify registration without updating the I-983

If USCIS cannot verify active E-Verify enrollment for the employer listed on the application at the exact time of filing, an RFE will follow. The response must include confirmation of enrollment — usually a screenshot or letter from the employer confirming the E-Verify Company ID and enrollment date.

Degree-to-Job Relationship Doubts

USCIS must be satisfied that your STEM degree directly relates to your job duties. If you hold a degree in mechanical engineering but are working as a financial data analyst, the adjudicator may not see the connection without an explicit explanation. The I-983 is where you make that case.

If your role sits in a field that is adjacent to your degree rather than squarely inside it — computational biology, environmental consulting, operations research — the I-983 must spell out how the specific technical and scientific content of the degree is applied in the role. An RFE on this point will ask you to provide more evidence of that direct relationship, sometimes including a statement from your employer describing how the role applies your academic training.

Prior Status Issues

If USCIS has any reason to question whether you maintained lawful F-1 status throughout your OPT — a gap in enrollment records, inconsistencies in your SEVIS history, or evidence of CPT that exceeded authorized limits — it may issue an RFE requesting documentation to establish continuous lawful status. These are among the most difficult RFEs to respond to because they require assembling transcripts, enrollment verifications, and DSO statements reaching back through your academic history.

Missing or Unsigned Documents

A smaller category, but it happens. An I-983 that is missing signatures in Section 4 or Section 6, an I-20 that was issued outside the 60-day window, or a photograph that does not meet USCIS specifications can each trigger an RFE. These are straightforward to correct but still cost you time.

How to Respond to a STEM OPT RFE

The RFE notice will state the specific deficiency and give you a deadline. Read the notice carefully — USCIS will tell you exactly what evidence it is requesting.

Step 1: Identify the precise deficiency. RFE language is formulaic. The notice will reference the specific regulatory basis for the request. Determine whether the issue is with the training plan, the E-Verify documentation, the degree-job relationship, or status evidence.

Step 2: Address only what was asked. Do not submit a packet that tries to fix things USCIS did not question. Excess material dilutes the response and can introduce new questions. Respond directly to what the RFE requested.

Step 3: If the issue is the I-983, rewrite Section 5 from scratch. Do not simply add a paragraph to the existing training plan. Rebuild the learning objectives with specific, measurable language that names the academic concepts applied in each task. If your employer's manager is the signatory, brief them on what changed and why the original version was deficient.

Step 4: Include a cover letter. A brief cover letter should identify the RFE notice number, state the applicant's name and A-Number, summarize what is being submitted and why it satisfies the RFE request, and list every document enclosed. Adjudicators process many files — a clear cover letter helps them see that the response is complete.

Step 5: Meet the deadline. The deadline printed on the RFE notice is the date USCIS must receive the response, not the date you mail it. Build in several days for shipping. Online filing may allow for electronic submission of the RFE response through the myUSCIS portal, which is faster.

What Happens After You Respond

USCIS will either approve the application, issue a Notice of Intent to Deny (NOID) — giving you one more opportunity to respond — or deny it outright. A NOID on a STEM OPT application is uncommon but serious; it means USCIS reviewed your RFE response and still has concerns.

During the pendency of the RFE, your 180-day automatic extension continues as long as the application was filed on time. You can keep working. The 180-day clock does not pause while USCIS waits for your response.

If USCIS denies the application after an RFE, you can file a motion to reopen (Form I-290B) within 33 days if you believe USCIS made a legal error. You cannot simply refile the same application with the same documents.

Avoiding an RFE: The Best Strategy

The I-983 Section 5 training objectives are where most STEM OPT RFEs originate. Reviewing dozens of USCIS-cited deficiencies shows the same pattern: generic job descriptions submitted as training plans. Before your application reaches USCIS, the I-983 should answer three questions for every learning objective listed:

1. What specific academic concept or technique from the degree is being applied?
2. How exactly does the daily work require and extend that concept?
3. How will the employer measure progress on this objective?

If the current draft of your I-983 cannot answer those three questions in concrete terms, revise it before filing.
