The marketing materials say $800,000. The reality is closer to $880,000 to $940,000 before you've paid a single attorney. Here is what EB-5 actually costs, broken down by category, with realistic ranges based on current market conditions.

The Capital Investment

The statutory minimum investment determines the floor:

  • $800,000 for investments in a Targeted Employment Area (TEA): rural areas, high-unemployment areas, or qualifying infrastructure projects
  • $1,050,000 for standard (non-TEA) investments

This capital must be placed at risk in a new commercial enterprise. It is not a fee — you should expect to have it returned eventually, though the timeline depends entirely on the project. Most EB-5 investments offer an annual return of 0.25% to 2%, so this is a capital preservation play, not an investment in the traditional sense. If a project promises significantly higher returns, that is a due diligence flag, not a benefit.

Regional Center Administrative Fees

If you invest through a Regional Center — which most post-RIA investors do — the Regional Center charges an administrative or syndication fee separate from your capital investment. This fee covers the cost of running the project, marketing to investors, fund administration, and overhead.

Current market range: $50,000 to $80,000 or more, paid upfront and not typically refundable. This fee does not go toward the $800,000 investment minimum. It is an additional cost on top of the capital.

Some Regional Centers have negotiated lower administrative fees for investors committing quickly or investing in multiple projects. Most do not.

USCIS Filing Fees

In 2024, USCIS attempted to significantly increase application fees. Following federal litigation (IIUSA v. USCIS), a court ruled the fee increases unlawful, and USCIS was required to revert to the pre-April 2024 fee schedule. As of November 2025, the reinstated fees are:

If you are outside the U.S. at the time of approval, you'll proceed through consular processing via DS-260 rather than I-485. The consular processing fee is $325 per person.

Derivative family members (spouse, unmarried children under 21) each require their own I-485 or DS-260 filing. Factor in $1,440 per derivative applicant if adjusting status inside the U.S.

Immigration Attorney Fees

You need legal counsel. There is no way to successfully prepare a USCIS-standard source of funds package without an attorney experienced in EB-5 documentation. Attorney fees for comprehensive EB-5 representation — from I-526E through I-829 — typically range from $15,000 to $35,000.

Complexity drives fees upward:

  • Multi-jurisdictional wealth transfers (funds originating in multiple countries)
  • Source of funds involving gifts, unsecured loans, or cryptocurrency
  • Concurrent filing of I-526E and I-485 with EAD and Advance Parole applications
  • Derivative family members requiring additional processing
  • RFE responses during adjudication

Some attorneys charge separately for the I-829 stage. Clarify the scope of the engagement before signing.

Securities Counsel Fees

Because EB-5 investments are structured as securities offerings, reviewing the Private Placement Memorandum with a securities attorney is strongly recommended. This is separate from immigration legal fees. Expect $5,000 to $15,000 for a thorough PPM review, depending on firm and document complexity.

Tax and Financial Planning Fees

This cost is widely underestimated. Upon receiving a U.S. green card, you become subject to U.S. taxation on your worldwide income. If you hold non-U.S. mutual funds (classified as Passive Foreign Investment Companies, or PFICs), interests in foreign companies, or assets in foreign trusts, the tax implications without advance planning can be catastrophic.

Pre-immigration tax planning with a qualified international tax advisor typically costs $5,000 to $15,000 or more for complex situations. This fee is not optional for investors with substantial international holdings — it is a cost of not facing a seven-figure tax bill after your green card is approved.

For a single applicant investing in a TEA Regional Center project:

For a non-TEA investment, substitute $1,050,000 for the capital line item, bringing the all-in total to approximately $1,135,000 to $1,200,000.

Costs That Marketing Materials Omit

A few additional expenses appear rarely in brochures:

Outbound remittance taxes: Indian investors face a Tax Collected at Source (TCS) on large foreign remittances. This is not a fee you pay to USCIS — it's a tax paid to the Indian government on the remittance itself. For an $800,000 transfer, the TCS liability must be factored into your liquidity planning.

Currency conversion costs: Wire transfer fees and foreign exchange spreads on large transfers can add several thousand dollars. On $800,000, even a 0.5% spread adds $4,000.

Bridge period costs: If you are on an employment-based or student visa and filing concurrently, you will need to maintain your current status until your EAD and Advance Parole are approved. Factor in any visa extension or status maintenance costs during this period.

Document authentication: Depending on your country of origin, some source of funds documents may require official translation, notarization, or apostille authentication. This varies by document type and country, but budget several hundred to several thousand dollars.
